Terms of Service

1. Who We Are

1.1 These Terms of Service (“Terms”) govern your use of the TafelTips iOS app and the website at tafeltips.nl (together, the “Service”).

1.2 The Service is operated by TafelTips (“we”, “us”), a service established in the Netherlands. Our contact details are set out in section 21.

1.3 By using the Service you accept these Terms. If you do not accept them, please do not use the Service.

1.4 Our Privacy Policy explains how we handle personal data and forms part of these Terms.

1.5 These Terms are published in Dutch and in English. If you are a consumer and the two versions differ, the Dutch version prevails.

2. What TafelTips Is — and Is Not

2.1 TafelTips is a restaurant discovery and table-availability service. We show which restaurants appear to have open tables, and we link you through to the restaurant or its booking provider.

2.2 TafelTips does not take bookings, hold tables, confirm or cancel reservations, process payments, or operate any restaurant’s reservation system.

2.3 If you reserve a table, that contract is between you and the restaurant, concluded through the restaurant’s own booking provider (for example Tebi, Formitable, Zenchef, or Guestplan). TafelTips is not a party to it, is not your agent, and is not liable for how the restaurant or the provider performs.

2.4 TafelTips has no commercial relationship with most of the venues it lists. Appearing in the Service is not an endorsement, a partnership, or a guarantee about a venue.

2.5 We do not currently accept payment for a listing, a placement, or a ranking position. If that ever changes, paid or sponsored content will be clearly labelled as such.

3. Eligibility

3.1 You must be at least 16 years old to use the Service. This matches the age at which, under Dutch law, a person can consent to the processing of their personal data by an online service.

3.2 You may not use the Service if you are barred from doing so under the laws of the Netherlands, the European Union, or your country of residence.

4. Accounts

4.1 Much of the Service works without an account. An account is needed to save favorites, publish a shareable list, or link a restaurant suggestion to you.

4.2 Accounts are created and secured through our authentication provider, Clerk. Where we offer it, you can sign in using a third-party identity provider, such as Sign in with Apple. Using such a provider is also subject to that provider’s own terms.

4.3 You are responsible for keeping access to your account secure and for activity that happens under it. Tell us promptly at [email protected] if you believe your account has been used without your permission.

4.4 One person, one account. Do not create accounts by automated means or share an account with others.

4.5 You can delete your account at any time from the account screen in the app or on the website. Deletion is described in section 7 of the Privacy Policy.

5. Favorites, Lists, and Suggestions

5.1 “Your Content” means what you add to the Service: favorites, list titles, the display name you choose for a published list, and restaurant suggestions.

5.2 You keep whatever rights you have in Your Content. You grant TafelTips a non-exclusive, worldwide, royalty-free, transferable licence, including the right to sublicense to the service providers we use to run the Service, to store, reproduce, adapt for technical purposes, and display Your Content in order to operate, promote, and improve the Service. This licence ends when you delete the content, except for (a) copies retained as described in the Privacy Policy, (b) copies in routine backups until those are overwritten, and (c) aggregated or anonymised data derived from Your Content that no longer identifies you, which we may retain and use indefinitely.

5.3 Published lists are public. Anyone with the share link can see the list title, the display name you chose, and the restaurants on it. There is no password on a share link, and links may be forwarded or indexed. Do not publish anything you would not want a stranger to read, and do not use your full name as a display name if you would rather not be identifiable. You can unpublish a list at any time, but copies already saved or cached by others are outside our control.

5.4 Do not submit content that is unlawful, defamatory, hateful, deceptive, infringing, or that contains someone else’s personal data.

5.5 Restaurant suggestions are reviewed before a venue is added, and we may accept, reject, edit, or ignore any suggestion. Factual information about a venue (its name, address, cuisine, opening hours) is not owned by the person who suggested it.

5.6 If you send us ideas, suggestions, or feedback about the Service, we may use them freely and without restriction, with no obligation, attribution, or payment to you.

5.7 We may remove or unpublish content that breaches these Terms, without notice where the breach is serious or unlawful.

6. Acceptable Use

You agree not to:

  • 6.1 Scrape, crawl, harvest, or bulk-copy the Service, its content, or its availability data, or use any of it to build, train, or improve a competing product, dataset, or model.
  • 6.2 Access the Service through bots, scripts, or other automated means, except a search engine crawler acting within our robots.txt.
  • 6.3 Circumvent or overload rate limits, including the fair-use limits on availability refresh requests, or place an unreasonable load on our systems or on the sources we rely on.
  • 6.4 Reverse engineer, decompile, or attempt to extract source code from the Service, except where that restriction is prohibited by law.
  • 6.5 Probe, scan, or test the security of the Service, or access accounts, data, or systems you are not authorised to access.
  • 6.6 Make speculative, fraudulent, or duplicate reservations at venues you find through the Service, or otherwise misuse the Service to the detriment of a restaurant.
  • 6.7 Use the Service to send spam, to advertise, or to impersonate another person or business.
  • 6.8 Use the Service for any unlawful purpose.

If you are a security researcher and believe you have found a vulnerability, please report it to [email protected] rather than exploiting it. We will not pursue good-faith research that is reported to us promptly, that does not access, modify, delete, or exfiltrate data belonging to anyone else, that does not degrade or disrupt the Service, and that is not disclosed publicly before we have had a reasonable opportunity to fix the issue.

7. Availability Information and Accuracy

7.1 Availability shown in the Service is derived from publicly available sources, as at the moment we last consulted them. It is an indication, not a promise.

7.2 A table shown as open may already be taken. A restaurant shown as full may have space. Times, party sizes, opening hours, prices, cuisines, addresses, and photos may be out of date or wrong.

7.3 “How busy a place looks” and any ranking or highlight in the Service are our own estimates from observed availability. They are not supplied, verified, or endorsed by the restaurant.

7.4 Always confirm with the restaurant before you travel. Do not rely on the Service for anything where being wrong would matter — a fixed occasion, dietary or accessibility requirements, or a large group.

7.5 If you are a restaurant and something about your venue is wrong, email [email protected]. We will review it and, where appropriate, correct or remove it.

8. Third-Party Services

8.1 The Service links to restaurants, booking providers, maps, and other third-party sites. We do not control them and are not responsible for their content, terms, privacy practices, or availability.

8.2 When you follow a link to book, you leave the Service. What happens from that point — the reservation, any deposit or no-show fee, cancellation rules — is between you, the restaurant, and its provider.

8.3 The Service depends on third-party infrastructure (authentication, hosting, analytics). Interruptions there may interrupt the Service.

9. Intellectual Property and Database Rights

9.1 The Service — its software, design, editorial text, and the TafelTips name and logo — belongs to TafelTips or its licensors and is protected by intellectual property law.

9.2 The collection of restaurant, availability, and ranking data made available through the Service is a database in which TafelTips holds the sui generis database right under the Dutch Databankenwet and Directive 96/9/EC. You may not extract or re-utilise a substantial part of that database, evaluated qualitatively or quantitatively, and you may not repeatedly and systematically extract or re-utilise insubstantial parts of it.

9.3 We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own private, non-commercial use, under these Terms.

9.4 That licence does not let you copy, redistribute, republish, or commercially exploit any part of the Service or its data. All rights not expressly granted are reserved.

9.5 Restaurant names, logos, and photographs belong to their owners and are used to identify the venue.

9.6 If you believe something in the Service infringes your rights, email [email protected] with enough detail to identify the material and the right you rely on. We will review it and take whatever action we consider appropriate.

10. Price and Changes to the Service

10.1 The Service is currently free. There are no in-app purchases and we do not collect payment details.

10.2 If we ever introduce paid features, we will say so clearly beforehand and paid features will never be applied retroactively to something you already have.

10.3 We may change, add, or remove features, cities, or venues at any time, and we may suspend the Service for maintenance. We aim to avoid disruption but we do not guarantee uninterrupted availability.

10.4 We may discontinue the Service, in whole or in part, at any time. Where reasonable we will give advance notice so that you can export or record anything you want to keep. We are not liable for discontinuing a service provided free of charge.

11. Suspension and Termination

11.1 You may stop using the Service and delete your account at any time.

11.2 We may suspend or terminate your access if you breach these Terms, if your use harms the Service, other users, or the restaurants and sources we rely on, or if we are required to by law. Where reasonable, we will tell you why and give you a chance to put it right.

11.3 On termination, your licence to use the Service ends. Sections 5.2, 5.6, 9, 12, 13, 14, 19, and 20, and any other clause that by its nature should survive, continue to apply.

12. Disclaimers

12.1 The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we give no warranties that it will be uninterrupted, error-free, secure, or that the information in it is accurate, complete, or current.

12.2 Nothing in these Terms excludes or limits your mandatory rights as a consumer under Dutch or EU law, our liability for damage caused by intent or deliberate recklessness (opzet of bewuste roekeloosheid) on our part, or any other liability that cannot be excluded or limited by law.

13. Limitation of Liability

13.1 Subject to section 12.2, and to the fullest extent permitted by law, TafelTips is not liable for indirect or consequential loss, loss of profit, loss of goodwill, loss of data, or wasted expenditure arising from your use of the Service.

13.2 In particular, we are not liable for a table that turns out not to be available, a booking a restaurant does not honour, a journey made in reliance on availability we displayed, or anything the restaurant or its booking provider does or fails to do.

13.3 Subject to section 12.2, our total liability for all claims together in connection with the Service is limited to EUR 25, or the total amount you paid us in the twelve months before the event giving rise to the claim, whichever is higher. The Service is supplied free of charge, and this limit reflects that.

13.4 Any claim in connection with the Service lapses if it is not brought within twelve months of the day on which you became aware, or reasonably should have become aware, of both the damage and our liability for it, to the extent the law allows.

14. Indemnity

14.1 You will indemnify TafelTips against any third-party claim, and against any loss, damage, penalty, or reasonable legal and advisory costs we incur, arising from (a) your breach of section 6, (b) your unlawful use of the Service, (c) Your Content, or (d) a reservation you make at a venue you found through the Service.

14.2 We will notify you of any claim covered by this section and will not settle it without consulting you first.

14.3 This section does not apply to the extent the claim results from our own intent or deliberate recklessness, and it does not affect your mandatory rights as a consumer.

15. Reporting Illegal Content

15.1 The Service lets users publish lists and submit restaurant suggestions. If you believe such content is illegal, send a notice to [email protected] that includes: where the content is (for example the share link), why you consider it illegal, and your name and email address.

15.2 We will confirm receipt, assess the notice without undue delay and in a diligent, non-arbitrary manner, and tell you what we decided and on what grounds.

15.3 The same address is our single point of contact for users and for authorities under the Digital Services Act. You may write to us in Dutch or in English.

16. Apple App Store

This section applies to the TafelTips iOS app obtained from Apple’s App Store.

  • 16.1 These Terms are between you and TafelTips only, not with Apple.
  • 16.2 Apple has no obligation to provide maintenance or support for the app.
  • 16.3 If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
  • 16.4 Apple is not responsible for addressing any claim relating to the app, including product liability, failure to conform to a legal or regulatory requirement, or consumer protection claims.
  • 16.5 Apple is not responsible for investigating, defending, or resolving any third-party claim that the app infringes intellectual property rights.
  • 16.6 You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • 16.7 Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Privacy

17.1 We process personal data as described in our Privacy Policy, in line with the GDPR.

17.2 We do not sell personal data, and we do not sell user profiles to restaurants.

18. Changes to these Terms

18.1 We may update these Terms, for example when the Service changes or the law does.

18.2 The current version is always available in the app and on the website, with the date it was last updated.

18.3 We will give notice of material changes, for example the next time you open the app or sign in. Continuing to use the Service after a change takes effect means you accept the updated Terms; if you do not accept them, stop using the Service and delete your account.

19. General

19.1 Assignment. We may transfer our rights and obligations under these Terms to another entity, for example if the Service is reorganised, contributed to a group company, or sold. Such a transfer will not reduce your rights under these Terms or the Privacy Policy. You may not transfer your rights or obligations without our written consent.

19.2 Force majeure. We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including outages at our hosting, authentication, or analytics providers, network or power failure, or acts of government.

19.3 Entire agreement. These Terms, together with the Privacy Policy, form the whole agreement between you and TafelTips regarding the Service.

19.4 No waiver. If we do not enforce a provision of these Terms, that is not a waiver of our right to enforce it later.

19.5 Severability. If a provision of these Terms is found invalid, the rest stays in force, and the invalid provision is replaced by a valid one that comes as close as possible to its intended effect.

20. Governing Law and Disputes

20.1 These Terms are governed by the law of the Netherlands.

20.2 Disputes will be submitted to the Rechtbank Amsterdam. If you are a consumer resident in the European Union, this does not deprive you of the protection of the mandatory law of your country of residence, or of your right to bring proceedings before the court of the place where you live.

20.3 We would rather hear from you directly first — most things are quicker to fix by email. Write to [email protected] and we will respond within a reasonable period.
